Darley Dale Neighbourhood Plan

Derbyshire Dales District Council on 19th February 2020 resolved to make the Darley Dale Neighbourhood Plan under Section 38A(4) of the Planning and Compulsory Purchase Act 2004. The Darley Dale Neighbourhood Plan now forms part of the Development Plan for Derbyshire Dales and will be taken into account in local planning decisions.

In making this decision the District Council considered that:

“The Neighbourhood Plan meets the basic conditions and its preparation process is compliant with legal and procedural requirements. Section 38A(4)(a) of the Planning and Compulsory Purchase Act 2004 requires the Council to make the Neighbourhood Plan if more than half of those voting in the referendum upon the plan have voted in favour of the plan being used to help decide planning applications in the area. The plan was endorsed by more than the required threshold in the referendum held on 21st January 2020.”

Darley Dale Neighbourhood Plan Referendum

A Referendum on Darley Dale Neighbourhood Plan was held on Tuesday 21st January 2020 when local people were invited to vote on this:

"Do you want Derbyshire Dales District Council to use the Neighbourhood Plan for Darley Dale Parish to help it decide planning applications in the neighbourhood area."

From an electorate of 4,725, 682 votes in favour and 117 against, so the vote was carried.

Decision Statement


The District Council, at the Environment & Community Committee on 30th October 2019 resolved that the recommendations as proposed by the Examiner are necessary to ensure that the draft Darley Dale Neighbourhood Plan meets the basic conditions and other relevant legal requirements. The District Council resolved that the Draft Darley Dale Neighbourhood Plan will now proceed to a Neighbourhood Planning Referendum on Tuesday 21st January 2020. Regulation 16: Darley Dale Neighbourhood Plan Documents

Darley Dale Town Council, with the help of the Neighbourhood Plan Group and the local community, has prepared a draft Neighbourhood Development Plan for their Parish. 

The plan sets out a vision for the future of the parish and planning policies which will be used to help determine planning applications in the area.

This plan proposal has been formally submitted to the District Council and was subject to a period of six weeks publicity from the 26/02/2019 to the 09/04/2019. The Darley Dale Neighbourhood Plan documents submitted can be viewed as follows:

Regulation 15: Submission November 2018

Darley Dale Neighbourhood Plan group submitted the Neighbourhood Plan (Submission Version), the Consultation Statement and the Basic Conditions Statement to the District Council 30th November 2018. The District Council and Neighbourhood Plan group are currently preparing for consultation on the Plan.

Sustainability Appraisal and Screening Report

In accordance with European Directive 2001/42/EC and the associated Environmental Assessment of Plans and Programmes Regulations 2004 a screening report on the draft Neighbourhood Development Plan has been carried out by the District Council to determine whether it requires a Strategic Environmental Assessment (SEA). The SEA Screening Report was sent to the statutory consultees for comment.  They concluded that a full SEA is not required. 

Regulation 14 Pre-Submission Consultation April 2018

In accordance with Regulation 14 of the Neighbourhhod Planning(General) Regulations 2012, the Darley Dale Neighbourhood Plan was published for formal consultation. The consultation period ran for a period of six weeks from 12th March untill 16th April 2018 and then for a further six weeks from 20th April until 4th June 2018. Background

The District Council received an area application from Darley Dale Town Council under section 61G of the Town and Country Planning Act 1990 (As amended by the Localism Act 2011) which sought the designation of the whole of the Parish of Darley Dale as a Neighbourhood Area. Following the completion of the six weeks consultation period, the application for designation of the area as a Neighbourhood Area was approved under the District Council's Scheme of Officer Delegation on 18 August 2014.
